Consult your condo corporation’s declaration to find your corporation’s legal name. For example, “Toronto Standard Condominium Corporation No. 9999”.

 

 

The Condo Registry

Total Voting Units

Voting Units” refers to the maximum number of votes that can be cast or counted at a meeting of owners.

Declaration” refers to a governing document that contains important information about the condo corporation, such as the percentage that the unit owner must contribute to the common expenses and a breakdown of the responsibilities for repairing and maintaining the units and common elements.

Condo Registry” refers to the CAO’s searchable condo registry that displays information prescribed in the regulation that is provided by condo corporations to the CAO through the filing of condo returns and notices of change.

A requisition must be signed by the owners of at least 15% of the voting units in the condo corporation (rounded up). E.g., If there is a total of 100 voting units, the total number of voting units required to sign the requisition is 15. The total number of voting units can be found in the declaration or on the CAO’s Condo Registry.

 

The information that populates this section of the questionnaire is provided to the CAO by condo corporations through condo returns and notices of change. Please manually input the correct information if any populated information is incorrect.

Topic of Meeting

At an owner-requisitioned meeting, the owners can discuss any topic with the board. Depending on the topic, owners may also be able to vote on those topics. It is important to note that owners do not have the ability to overturn a decision of the board at an owner-requisitioned meeting unless the Condo Act gives owners the ability to approve that decision.

Director Removal Information

“Owner-occupied” refers to a residential condo unit where the owner has not leased the unit within 60 days of receiving a notice of a meeting to elect or remove a director. 

You can find out if a director has an owner-occupied position by asking the board and/or condo manager, or by reviewing your condo corporation’s records. 

If the meeting is to remove one or more directors, then the requisition must include:

  • The names of the directors who are proposed to be removed.
  • The reasons for removal.
  • An indication of whether one of the directors proposed to be removed occupies a position on the board reserved for voting by owners of owner-occupied units.

You can find out if a director has an owner-occupied position by asking the board and/or condo manager, or by reviewing your condo corporation’s records.

Preferred Board Response to Requisition

After receiving a requisition, the board is required to do one of the following: 

  • ​​​​Call and hold a meeting of owners within 35 days.
  • Add the topics included in the requisition to the agenda for the next annual general meeting, but only if requested by the requisitionists.

Signatures of Eligible Units

A signature form will be generated with your requisition form.

 

A valid requisition must be signed by the owners of at least 15% of the voting units in the condo corporation. To sign this requisition, a person must:

  • Be the owner of a unit.
  • Be entitled to vote on behalf of their unit.
  • Not be in arrears for any common expenses for 30 days or more.

Additional considerations:

  • Tenants or other non-owner occupants of a unit cannot sign a requisition.
  • Owners of multiple units only need to sign the requisition form once but must identify all the units they own in the unit number column of the requisition’s signature page.
  • The joint-owners of a single unit may sign the requisition if a majority of the joint owners agree to signing.
  • Electronic signatures may be used to sign a requisition if the signatures meet the requirements of section 11 of the Electronic Commerce Act, 2000.

A requisition must be signed by the owners of 15% of the voting units in the condo corporation to be valid. A valid requisition can be delivered to the condo by delivering it personally or by registered mail to the condo’s president or secretary, or by delivering it to the condo’s address for service.
